Rezime: Intelektualna svojina i
Internet su dva fenomena koja su se nametnula čovečanstvu krajem
20-tog veka sa procenama da im tek u tekućem veku predstoji puna
ekspanzija. Ovi fenomeni, međutim, poseduju dva suprotna svojstva.
Klasična zaštita intelektualne svojine je zasnovana na
teritorijalnom principu dok je Internet neteritorijalan. Zbog tih
suprotnih osobina, došlo je do njihovog sudara u kome su nastali
veliki problemi koje zajednički razrešavaju svetska organizacija za
intelektualnu svojinu – WIPO i organizacija nadležna za dodelu
internet domena – ICANN.
THE CONFLICT BETWEEN
THE INTERNET AND INTELLECTUAL PROPERTY
Apstract: Intellectual property and
the Internet are two phenomene that are imposed humanity at the end
of 20th century with forecast that they will grow in
curent century. This apparitions have two contrasted
characteristics. Clasic protection of Intelectual propperty is based
on territori principles, but the Internet is not territorial.
Because of these characteristic the Conflict emerged. The solution
for this Conflict is being looked for by contrasted WIPO (World
Intellectual Property Organization) and ICANN (Internet Corporation
for Assigned Names and Numbers)
